1. Agreement

By accessing or using SiteRead (“the Service”), a product of Elevision LLC (“we,” “us,” “our”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

SiteRead is a web-based land prospecting and site screening platform. It provides parcel data, mapping layers, site scoring, development signal tracking, and data export tools to assist real estate development professionals in evaluating land opportunities.

3. Accounts

Some features require a registered account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information and promptly update it if it changes.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service or its systems
• Scrape, crawl, or use automated tools to extract data from the Service beyond normal use
• Resell, redistribute, or sublicense data obtained from the Service without our written consent
• Interfere with the operation of the Service or impose unreasonable load on our infrastructure

5. Data Accuracy Disclaimer

SiteRead aggregates publicly available data from government sources including county assessor records, FEMA flood maps, school accountability ratings, census data, and other public databases. While we strive for accuracy, we do not warrant that the data is complete, current, or error-free.

The data provided through SiteRead is for informational purposes only and does not constitute professional advice. You should independently verify all data — including but not limited to parcel boundaries, ownership, acreage, flood zone designations, and market values — before making any investment, acquisition, or development decisions.

6. Site Scores and Analysis

The site scores, product fit recommendations, and analysis provided by SiteRead are algorithmically generated and intended as screening tools only. They are not a substitute for professional due diligence, appraisal, engineering studies, environmental assessments, or legal review. We make no representations regarding the suitability of any site for development.

7. Intellectual Property

The Service, including its design, software, scoring algorithms, and user interface, is owned by Elevision LLC and protected by applicable intellectual property laws. The underlying public data displayed through the Service is not owned by us.

Data you export from SiteRead (parcel records, owner information) originates from public sources and may be used in accordance with applicable laws governing public records.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELEVISION LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10. Termination

We may suspend or terminate your access to the Service at our discretion, with or without cause, and with or without notice. You may delete your account at any time through Account Settings.

11. Changes to Terms

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms. Material changes will be communicated via email or a notice in the Service.

12. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts located in Harris County, Texas.
